Australian manufacturers and importers (suppliers) are responsible for any
product they supply to the Australian market.
By way of an ACA recognised "Agent Agreement" however, Australian manufacturers or importers (suppliers)
can delegate all or share
their compliance responsibilities by appointing an
"Agent". The "Agent Agreement"
can stipulate the degree of responsibility the "Agent" will assume
regarding compliance and to what products the agreement applies.
Some examples of how the "Agent Agreement" may define the
"Agent's" responsibility:

review of product compliance documentation and establishment of Compliance
Folder;
NOTE: Australian
manufacturer or importer (supplier) still signs Declaration of Conformity
and labels product with their own compliance label (i.e. their ACA Supplier
Code appears on the product)
full compliance responsibility
review of product compliance documentation and establishment of Compliance
Folder plus signing of Declaration of Conformity plus
"Agent's" ACA Supplier Code is used on compliance label;
Products Covered by Agreement
Some examples of how the "Agent Agreement" may define which
products are covered under the agreement:
all products supplied by the Australian manufacturer or importer
(supplier);
in the case of an Australian importer (supplier), all products sourced
from a particular overseas supplier which are to be supplied by that
importer to the Australian market;
NOTE: Stanimore "Agent Agreements" usually identify such
products by way of an Annex to the agreement. The Annex is updated to reflect
each new product included after the initial signing of the agreement.

multiple products)

Of course the least resource intensive arrangement for the Australian
manufacturer or importer (supplier) is where the "Agent" takes full
responsibility for all products supplied by the manufacturer or importer
(supplier) and where the "Agent" agrees to the use of the
"Agent's" ACA Supplier
Code on the compliance label of all product supplied under the "Agent
Agreement".
New Zealand EMC Compliance
In relation to EMC regulatory requirements, Stanimore can act as
"Agent" to Australian manufacturers and importers also targeting the
New Zealand market.
